Live Like DJ Silent Auction Terms of Use

These Terms of Use ("Terms") govern the Live Like DJ Silent Auction application operated by TEAM55 (publicly styled Team 55, "we," "us," or "our"), a 501(c)(3) public charity, in support of the Live Like D.J. - Dwon Fields Jr. Scholarship Fund ("the Scholarship Fund"). By using the application or submitting an auction item, you agree to these Terms and the Privacy Notice at https://livelikedj.org/privacy. If you do not agree, do not submit information through the application. The Community Foundation of the Lowcountry administers scholarship selection approval and distribution; it is not identified here as the operator of this application.

Who may use the application

You must be at least 18 years old and legally able to donate the item. A parent, guardian, or other legally authorized adult must act where applicable. If you submit an item or information for an organization or another person, you represent that you have authority to do so and to grant the permissions described in these Terms.

The private staff workspace is limited to people approved by Live Like DJ. Staff must use an authorized Google account, protect access to that account, follow their assigned role, and promptly report lost access or suspected misuse. Authorization to use the staff application does not by itself grant direct access to TEAM55's Google Sheets, Drive files, Square account, or other systems.

Current application scope

The application lets people offer auction items, lets staff review and coordinate those items, displays an approved preview, imports a limited read-only record of completed Square event sales, and supports private golf and sponsor fulfillment.

The application does not accept online bids, auction payments, raffle-ticket purchases, or card details. Bidding and payment take place on site under the event rules announced there. Public visitors and donors do not need a Google account, and Google sign-in is not required to identify a bidder or participate in the auction. The preview does not guarantee that an item will remain available or appear exactly as shown.

Offering an auction item

When you submit an item, you represent that:

• the information you provide is accurate to the best of your knowledge;
• you own the item or are authorized to donate it;
• the item, photograph, description, and proposed transfer do not violate law, another person's rights, a contract, or a platform rule;
• you have disclosed material restrictions, expiration dates, defects, exclusions, delivery requirements, and other facts needed to describe and fulfill the item accurately; and
• Live Like DJ may contact you about review, acceptance, delivery, pickup, acknowledgment, changes, withdrawal, or return.

A submission is an offer, not an acceptance. Live Like DJ may request more information, edit proposed public copy for accuracy or presentation, decline an item, delay or remove a preview, set auction procedures, withdraw an item from the event, or arrange return where appropriate. We will not intentionally publish donor contact, pickup, private-note, or source-file information.

Photographs and public recognition

You retain rights you already hold in submitted content. You grant Live Like DJ a nonexclusive, royalty-free permission to store, review, resize, crop, and use an approved version of an item photograph and description to administer and promote the auction and scholarship mission. This permission lasts until the content is no longer reasonably needed for those purposes or you withdraw it, subject to completed uses, backups, records we are required to retain, and the reviewed removal process described in the Privacy Notice.

Public donor or organization recognition is optional. We will use it only when you choose that option and provide the exact display name. You represent that you may authorize that public display.

Values, acknowledgments, and taxes

Any estimated retail value entered in the application is supplied for auction planning. Live Like DJ does not appraise donated property, determine fair market value for the donor, promise a tax deduction, or provide tax or legal advice. A requested acknowledgment confirms only the information that the organization is authorized to confirm. Donors are responsible for obtaining their own professional advice and records.

Auction and event rules

The public gallery is a preview only. On-site bidding, closing, tie handling, winner determination, payment, pickup, refunds, and disputes are governed by the final posted or announced event rules. Item descriptions may contain donor-provided limitations, and experiences, services, certificates, and perishable or time-limited items may have additional restrictions.

The application does not promise that every submitted or previewed item will be offered, that every item will receive a bid, that a particular amount will be raised, or that every event or service will occur as scheduled. Square or other event pages may provide registration, sponsorship, donation, or point-of-sale services under their own terms; this application does not process those payments.

Acceptable use

You may not:

• submit unlawful, stolen, unsafe, counterfeit, infringing, deceptive, or unauthorized items or content;
• upload malware, attempt to bypass validation or access controls, probe private records, impersonate another person, or interfere with the application;
• use another person's contact information, Google identity, staff access, or Square information without authorization;
• scrape, republish, or exploit private or public content in a way that violates law, privacy, these Terms, or the scholarship mission;
• use the application to collect card details, government identifiers, health information, gift-card or certificate redemption codes, or unrelated private documents; or
• represent the preview as an online bidding, payment, or raffle-sales system.

We may reject a submission, restrict staff access, remove public content, or suspend an affected feature when reasonably necessary to protect people, records, services, or the event.

Privacy

The Privacy Notice at https://livelikedj.org/privacy describes the information the application collects, how Google staff identity and Square event-sale data are used, service-provider disclosures, security, retention, and available requests. Review it before submitting information.

Third-party services and links

The application uses or links to services provided by Google and Square, and transactional messages may pass through email providers. Third-party services are governed by their own terms and may be temporarily unavailable or changed by their providers. A link does not authorize a user to access a private system or imply that Live Like DJ controls the third party.

Availability and changes

We may correct, update, pause, or discontinue an application feature, public preview, or event workflow. We may update these Terms when the application, event, or applicable requirements change. The public page will show the current effective date, and a material change will receive any additional notice or consent the owner determines is required. A donor submission remains associated with the terms version accepted at submission.

Disclaimers and responsibility limits

The application and preview are provided on an "as available" basis. To the extent permitted by applicable law, Live Like DJ does not make warranties about uninterrupted availability, the accuracy of donor-supplied information, item condition or value, third-party services, or a particular auction result.

Nothing in these Terms excludes a right or responsibility that cannot lawfully be excluded.
